11. It’s possible that not all devices will be compatible with Yenepoya’s goods, services, or content. Unless otherwise noted, Yenepoya is not committed to offering functional products and services for phones or tablets.
12. Neither Yenepoya nor any of its affiliates or content partners shall be liable for any loss or damage to a tablet, phone, or other hardware and software, including data loss or a slowdown in the tablet’s processing speed, that arises from the use of our products and services.
13. Under no circumstances will Yenepoya be liable for damages of any kind, including without limitation: indirect, punitive, special, exemplary, incidental, or consequential damages (including loss of business, revenue, profits, use, data, or other economic advantages, loss of programmes or information), or (ii) direct damages that exceed the amount paid to Yenepoya for the product or service and result from the use, misuse, inability to use, or errors, omissions, or other defects. The limitation or exclusion of responsibility is prohibited in some jurisdictions. Therefore, under such circumstances, the User may not be covered by some of the restrictions mentioned above.
14. In order to notify the user of essential updates, Yenepoya may also call, SMS, or email the user. Therefore, in the event that the user’s cell phone number is listed in the Do Not Call (DNC) database, the user holds Yenepoya responsible for any liabilities, including financial fines, damages, and expenses.
15. You agree to indemnify, defend, and hold harmless Yenepoya, its resellers, distributors, service providers, suppliers, and other authorised users, as well as each of the entities as mentioned above’ officers, directors, owners, employees, agents, and representatives from and against any and all losses, damages, liabilities, and costs resulting from your use of our product.
16. In the event that the User violates any of the terms and conditions of these Terms of Use, the User is immediately responsible for compensating Yenepoya for any costs, losses, and damages incurred as a result of the violation.
17. You acknowledge that if you violate these terms of service, Yenepoya will suffer irreparable injury and won’t have access to an acceptable remedy in the form of money or other financial compensation. Therefore, upon request, Yenepoya shall have the right to ask any court of competent jurisdiction for an injunction to prevent such a breach. The ability of Yenepoya to secure such relief shall not preclude Yenepoya from seeking additional remedies.
18. To utilise our goods or services, a person must be “competent/capable” of contracting as defined by the Indian Contract Act of 1872. We do not allow children, insolvents who have not been dismissed, etc., to use our products or services. You must have your legal guardian or parents’ permission if you are a minor and want to use our products or services. Any consequences resulting from the misuse of any of our products or services, including those caused by minors using the services, will not be the responsibility of Yenepoya. By using the goods or services, you represent and warrant that all the information you have provided is true and correct and that you have a parent’s or legal guardian’s permission (in the case of minors). Suppose it is determined that you are under 18 years old, that your parent or legal guardian has not consented to using the products or services, or that any information you have provided is untrue. In that case, Yenepoya reserves the right to cancel your subscription and refuse to grant you access to the products or services.
19. Users of this platform are not allowed to host, display, upload, modify, publish, transmit, update, or share any content that:
    • belongs to another person and over which they have no legal authority;
    •  is gravely harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invading another person’s privacy, hateful, or racially or ethnically objectionable
    • violates any already applicable law;
    • misleading the addressee about the source of the messages or sending any information that is blatantly insulting or ominous in character;
    • impersonate another person;
    • contains computer code, files, or programmes that have the ability to interrupt, delete, or restrict the use of any computer resource;
    • harms India’s unity, integrity, defence, security, or sovereignty; cordial relations with other countries; or public order. It also encourages the commission of any crimes punishable by law, obstructs the investigation of any crimes, or insults any other country.

Any failure or delay in our performance of our contractual duties resulting from causes beyond our reasonable control or due to force majeure shall not subject us to liability.
